This Privacy Policy ("Policy") describes the information practices of Scale Systems LLC, doing business as "ScaleLocal" ("ScaleLocal", "we", "us", or "our"), located at 3560 NC 98 Hwy W, Youngsville, NC 27596. It applies to our websites (including scalelocal.ai and related domains), our proprietary software and platforms (including CurbMailers, FieldRank, EstimateIQ, and VisibilityIQ), our artificial-intelligence products (including AI receptionist, chatbot, lead follow-up, and custom AI agents), our marketing and consulting services, and all of the ways you interact or communicate with us (collectively, the "Services").
ScaleLocal is a growth partner, software company, and data-driven advertising business. We collect, buy, license, enrich, analyze, use, share, disclose, and sell personal and business information as a core part of our business. We want to be transparent about that, and this Policy is written to describe those practices broadly while also giving you the rights and choices required by applicable law. Please read it carefully. If you do not agree with this Policy, do not use the Services or provide information to us.
This Policy applies to personal information we collect from or about consumers, website visitors, prospective and current clients, the customers and contacts of our clients, leads, survey respondents, and other individuals whose information we obtain from any source. It does not apply to information governed by a separate written agreement that expressly supersedes it, or to the independent privacy practices of our clients or third parties.
Affirmative acknowledgment. By using the Services, submitting information to us, entering your contact details on any form, engaging with our marketing, or communicating with us through any channel, you affirmatively acknowledge and agree to the collection, use, disclosure, sale, and sharing of information as described in this Policy, to the maximum extent permitted by applicable law.
Your responsibility for information you provide. If you provide us with information about other people (for example, if you are a client uploading contact lists, leads, or customer records), you represent and warrant that you have all necessary rights, consents, and legal authority to provide that information to us and to authorize us to use, process, enrich, share, and sell it as described here, and that our doing so will not violate any law or any third party's rights. You assume full responsibility for information you submit and agree to indemnify us for any claim arising from it.

Building, training, and improving software and artificial intelligence is central to our business. Subject to applicable law, you grant us the right to use the information we collect, receive, generate, and derive — including communications content, call and chat transcripts, voice recordings, engagement data, leads, and enriched datasets — to develop, train, evaluate, fine-tune, benchmark, and improve our algorithms, machine-learning models, and AI systems and products, and to create derived data, models, insights, and outputs.
Where we create de-identified, pseudonymized, aggregated, or synthetic data, we may use, retain, share, and sell it without restriction, and we commit to maintaining and using such data in de-identified form and not attempting to re-identify it except as permitted by law. We reserve the right to use data for these purposes to the maximum extent permitted by law, including using technologies and methods not yet developed.
We and our clients communicate with consumers across many channels. This section describes those channels and your consent and opt-out choices. By providing your contact information and/or opting in, you consent to receive communications from us and, where applicable, from our clients, through the channels below. Message and data rates may apply. Consent to receive marketing messages is not a condition of any purchase.
By providing your mobile or telephone number to us or to one of our clients — on any form, in person, verbally, by text, or by any other means — you expressly agree and consent that we and our clients may contact you by SMS/text message at that number for marketing, promotional, special-offer, transactional, and informational purposes, including recurring automated messages, and you represent that you are the subscriber or regular user of that number and are authorized to give this consent. Providing your number is itself your agreement to receive these messages; no separate sign-up is required. We follow industry SMS standards, including the CTIA Messaging Principles and carrier A2P 10DLC requirements. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can get help by replying HELP or contacting us at info@scalelocal.ai. We will also honor opt-out requests made through any other reasonable method. After you opt out, you may receive a single confirmation message. Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not required to purchase any goods or services.
Where you opt in, we may communicate with you via WhatsApp and other Meta messaging services, using approved message templates. Your use of these services is also subject to WhatsApp's and Meta's own terms and policies. Consent must be clear and voluntary; you may opt out by replying STOP or by following the unsubscribe instructions in a message, and we will honor such requests and applicable platform limits on marketing messages.
We send marketing, promotional, transactional, and service emails. Our commercial emails identify the sender, include a valid physical postal address, and provide a clear way to unsubscribe. You may opt out of marketing emails by clicking "unsubscribe" or contacting us; we will process opt-outs promptly as required by the CAN-SPAM Act. We may still send you non-marketing, transactional, or relationship messages.
We and our clients may place and receive telephone calls, including calls placed or answered by automated and artificial-intelligence voice agents. Where you have provided the required consent, calls may be made using automated dialing technology or prerecorded/artificial voices. We may record and transcribe calls for quality assurance, training, analytics, AI development, compliance, and record-keeping. Where required by law (including in "all-party" / two-party consent states such as California, Florida, Illinois, Washington, and others), we will notify you that a call is being recorded and, where required, that you are interacting with an AI agent, before the substantive conversation begins; by continuing the call you consent to the recording and, where applicable, to AI interaction. You may decline recording or request a human by so stating on the call. You may also register your number on applicable Do-Not-Call lists.
Where permitted by law and consent, we may deliver voicemail messages, including ringless voicemail. You may opt out by following the instructions provided or contacting us.
Our websites and Services may offer live chat and AI-powered chatbots. Conversations may be recorded, logged, and used to respond to you, improve the Services, and train our AI systems. Where required, we will disclose that you are interacting with an automated system.
If you use our applications, we may send push notifications. You can disable them through your device settings.
We may contact you by postal direct mail and through social-media direct messages and platform messaging tools, subject to those platforms' terms.
You consent to receive communications from us and, where applicable, our clients through any other or future or emerging communication channel we may adopt, including any technologies or channels not yet developed, subject to the consent and opt-out rights required by applicable law. We sell and share personal information, and we want to be clear about that. Under laws such as the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), and similar state laws, "sale" means disclosing personal information to a third party for monetary or other valuable consideration, and "sharing" means disclosing personal information for cross-context behavioral (targeted) advertising.
In the preceding twelve months, we have sold and/or shared, and we may continue to sell and/or share, the following categories of personal information: identifiers; customer records and commercial information; internet and other electronic network activity; geolocation data; professional information; and inferences and profiles derived from the foregoing. We sell and share these categories with data buyers and brokers, advertising partners and networks, marketing and lead-generation partners, affiliates, and our clients.
We do not knowingly sell or share the personal information of consumers we know to be under 16 years of age without affirmative authorization as required by law. You have the right to opt out of the sale and sharing of your personal information, as described in the "Your Rights and Choices" and "Do Not Sell or Share" sections below.
We and our partners use cookies, web beacons, pixels, tags, SDKs, local storage, and similar technologies to operate our websites, remember your preferences, measure and improve performance, and deliver and measure advertising, including targeted and cross-context behavioral advertising. Some of these technologies are provided by third parties (such as analytics and advertising providers) who may collect information about your activity across sites and services over time.

Because these technologies may constitute a "sale" or "sharing" of personal information under some state laws, we treat opt-out preference signals as described below. Note that some tracking is necessary for the Services to function and cannot be disabled.

How to exercise your rights. You may submit a request by emailing info@scalelocal.ai, or through any request mechanism we make available. We will verify your request as required by law and may ask for information to confirm your identity. You may use an authorized agent to submit a request on your behalf, subject to verification. We will respond within the timeframes required by applicable law (generally 45 days, extendable as permitted). If we deny your request, you may appeal by replying to our decision or contacting us at the same address; if your appeal is denied, you may contact your state Attorney General.
Global Privacy Control. Where required, we honor GPC and similar universal opt-out signals as a request to opt out of sale/sharing and targeted advertising for that browser or device.

California residents have the rights to know, access, delete, correct, and to opt out of sale and sharing, and to limit the use of sensitive personal information, and the right to non-discrimination. The categories of personal information we collect, the sources, purposes, and the categories we disclose, sell, and share are described in Sections 2, 3, 7, and 8 of this Policy. To the extent any of our data practices constitute a financial incentive, we will describe its material terms and obtain consent where required.

Because we buy, license, append, and sell personal information, some of our activities may cause us to qualify as a “data broker” under the California Delete Act and comparable laws in other states (such as Texas, Oregon, and Vermont). Where we are required to do so, we register as a data broker with the California Privacy Protection Agency (CPPA) and any applicable state authority, maintain that registration, and honor deletion requests submitted through the state’s designated deletion mechanism (including California’s DROP platform) as and when required by law. To the extent we collect information classified as "sensitive personal information" or "sensitive data" under applicable law (for example, precise geolocation, account credentials, or certain government identifiers), we use and disclose it only for purposes permitted by law and, where required, only with your consent or subject to your right to limit its use. We do not use sensitive information to infer characteristics about you except as permitted. Where a state law requires opt-in consent before processing sensitive data, we will obtain it as required.
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide the Services, build and improve our software and AI, pursue our legitimate business and commercial interests, maintain business records, and comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by the type of information, the purpose for which it is used, and applicable legal requirements. We may retain de-identified, aggregated, and derived data indefinitely. When information is no longer needed, we will delete, de-identify, or anonymize it in accordance with our retention practices and applicable law.
We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. To the maximum extent permitted by law, we are not responsible for the unauthorized acts of third parties, and you use the Services and provide information at your own risk. You are responsible for maintaining the confidentiality of any credentials you use to access the Services.
Our Services are intended for businesses and adults and are not directed to children under 13, and we do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA). We also do not knowingly sell or share the personal information of consumers under 16 without the affirmative authorization required by applicable state law. The Services are intended for and directed only to users located in the United States and are designed for a United States audience. We do not offer or direct the Services to, and do not intend to establish operations in or target, individuals located in the European Economic Area (EEA), the United Kingdom, Switzerland, or other jurisdictions outside the United States. If you are located in the EEA, the United Kingdom, Switzerland, or any other such jurisdiction, please do not use the Services or submit personal information to us; we do not knowingly solicit or process personal data from individuals in those regions, and we do not offer goods or services to, or monitor the behavior of, individuals located there within the meaning of the EU or UK GDPR.
All information is transferred to, stored, and processed in the United States, which may have data-protection laws different from those in your country. By using the Services, you acknowledge that the Services are U.S.-based and consent to the transfer and processing of your information in the United States. To the extent any non-U.S. data-protection law is nonetheless found to apply to a particular processing activity, we will provide the additional disclosures and rights, and implement the transfer safeguards, required by that law to the extent required; nothing in this Policy waives any right you cannot lawfully waive.
The Services may contain links to, or integrate with, third-party websites, platforms, and services (such as Google, Meta, WhatsApp, telecommunications carriers, CRM and messaging platforms, and advertising networks). We are not responsible for the privacy practices or content of those third parties, and their processing of your information is governed by their own privacy policies and terms. We encourage you to review them. Our provision of, or connection to, a third-party service does not constitute an endorsement.
By using the Services or providing information to us, you provide affirmative consent to the practices described in this Policy, to the maximum extent permitted by law. If you provide us with information about other individuals, or authorize us to communicate with or market to others on your behalf, you assume full responsibility for obtaining all required consents and complying with all applicable laws, and you agree to indemnify and hold us harmless from any resulting claims. We reserve all rights not expressly limited by law, including the right to collect, use, enrich, share, and sell data, and to adopt new technologies, channels, and data practices, including any not yet developed, subject only to the mandatory rights and disclosures required by applicable law.
We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or business. When we make changes, we will revise the "Last updated" date at the top of this Policy and, where required by law, provide additional notice. Your continued use of the Services after an updated Policy becomes effective constitutes your acceptance of the changes, to the extent permitted by law. This Policy is governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles, and any dispute relating to it shall be brought exclusively in the state or federal courts located in Wake County, North Carolina, to the extent permitted by applicable law.
